The consumer's phone number is considered personal data and is stored securely in our customer database and with our SMS service provider (Shopify Messaging).
  • Patreon Membership Data: If the consumer subscribes to our Super Mega Club on Patreon, we collect membership status, subscription tier, payment history through Patreon, and the consumer's Patreon username to verify benefits eligibility and provide member-exclusive access.
  • Discord Information: If the consumer links their Discord account to access Super Mega Club benefits, we collect the consumer's Discord username and user ID to assign special roles and grant access to member-only channels, hangouts, and events.

3. How We Use Your Data

We use the consumer's data to:

  • Process and fulfill orders.
  • Provide customer support.
  • Send order updates, transactional notifications, and marketing communications (if opted in).
  • Improve our website and services.
  • Detect and prevent fraud.
  • Send promotional SMS messages about our products, exclusive deals, new releases, and special offers (only if the consumer has provided express consent).
  • Send transactional SMS messages such as order confirmations, shipping updates, and delivery notifications.
  • Send cart reminder messages via SMS when items are left in the consumer's cart (only if the consumer has provided express consent).
  • Verify Super Mega Club membership status and provide member benefits including early access to limited edition items, free shipping credits (up to $10 per order), album credit mentions, Discord role assignment, and access to exclusive events.
  • Track membership tenure to determine eligibility for tenure-based benefits such as free shipping every 5 consecutive months.
  • Communicate with Super Mega Club members about exclusive sales, listening parties, giveaways, and member-only opportunities.

5. Data Sharing

We do not sell the consumer's personal data. However, we may share data with:

  • Payment Processors: To securely process transactions.
  • Shipping Providers: To fulfill the consumer's orders.
  • SMS Service Providers: We use Shopify Messaging to send SMS marketing and transactional messages. The consumer's phone number and message content are shared with Shopify to facilitate message delivery. Shopify processes this data in accordance with their privacy policy.
  • Patreon: When the consumer subscribes to our Super Mega Club, Patreon processes the consumer's payment and membership data. We receive limited information from Patreon (membership status, tier, email) to verify the consumer's eligibility for benefits. Patreon's use of the consumer's data is governed by their privacy policy.
  • Discord: When the consumer links their Discord account to access Super Mega Club benefits, we share the consumer's membership verification status with Discord to assign roles and grant channel access. Discord's use of the consumer's data is governed by their privacy policy.
  • Marketing & Advertising Partners: If the consumer has consented to marketing communications.
  • Ad Platforms for Audience Targeting: We may use hashed customer data (such as email addresses or phone numbers) to create lookalike or custom audiences on platforms like Meta, Google, TikTok, and Reddit. This helps us show relevant promotions to people who have similar interests to our customers. The consumer can opt out of this by contacting us.
  • Legal Authorities: If required to comply with legal obligations.

IMPORTANT: Text messaging originator opt-in data and consent will NEVER be shared with any third parties for their own marketing purposes. The consumer's consent to receive SMS messages from Human Sweat Records is solely for our use and will not be sold, rented, or shared with other companies for marketing.

6. How We Store and Secure Your SMS Data

The consumer's phone number and SMS consent preferences are stored securely in our customer database and with our SMS service provider, Shopify. We implement appropriate technical and organizational measures to protect the consumer's data from unauthorized access, including:

  • Encryption of data in transit and at rest
  • Access controls limiting who can view the consumer's phone number
  • Regular security audits and updates
  • Secure data storage with our trusted service providers

We retain the consumer's phone number and SMS consent data for as long as they remain subscribed to our SMS program, or as required by law. If the consumer opts out of SMS messages, we will retain a record of their opt-out to ensure we do not contact them again via SMS.

7. Data Retention

We retain personal data as long as necessary for the purposes stated above or as required by law. Specifically:

  • Order and transaction data: Retained for accounting and legal compliance purposes (typically 7 years)
  • Marketing consent and preferences: Retained until the consumer withdraws consent or requests deletion
  • SMS opt-out records: Retained indefinitely to honor the consumer's preference not to be contacted
  • Super Mega Club membership data: Retained for the duration of the consumer's active membership and for up to 12 months after cancellation to facilitate reactivation and provide tenure-based benefits upon renewal. Album credit mentions are permanent as they become part of published album metadata.

8. Your Rights

The consumer has the right to:

  • Request access to their personal data, including their phone number, SMS consent status, Patreon membership information, and Discord account linkage.
  • Request correction or deletion of their data.
  • Withdraw consent for marketing communications at any time.
  • Opt out of SMS communications at any time by replying "STOP" to any message. The consumer will receive a confirmation message, and no further marketing messages will be sent unless they opt in again.
  • Cancel their Super Mega Club membership at any time through Patreon. Benefits will remain active until the end of the consumer's current billing period.
  • Unlink their Discord account from Super Mega Club benefits by contacting us, which will remove their special role and access to member-only channels.
  • Request data portability. The consumer can request a copy of their data in a machine-readable format.
  • Object to the processing of their data for marketing purposes.
  • File a complaint with a data protection authority if the consumer believes their rights have been violated.

For UK and EU residents, these rights are protected under the UK GDPR, EU GDPR, and Privacy and Electronic Communications Regulations (PECR). For US residents, their rights may vary by state.
