This website is owned and operated by Human Sweat Records. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors the ability to purchase music albums and related items, participate in membership programs, and participate in referral programs. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.

2. User Eligibility

In order to use our website and/or receive our services, you must possess the legal authority, right, and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you. Users must create an account to access the referral program and membership programs.

3. Key Commercial Terms

Pricing: The prices for music albums and related items are clearly displayed on the website in USD currency. Shipping is an additional charge unless otherwise specified. Shipping rates include packaging and handling fees to ensure your vinyl arrives safe and sound.

International Orders - Import Duties and Customs: Orders placed by customers outside the United States are subject to import duties, customs taxes, brokerage fees, handling fees, and other charges imposed by the importing country's authorities. These charges are entirely the responsibility of the customer and will be assessed by customs authorities upon delivery. The customer will be required to pay these charges in full to accept delivery of the order. Human Sweat Records has no control over these costs and cannot predict, reduce, or refund any import-related charges.

European Union - VAT Handling: For customers in the European Union, Value Added Tax (VAT) is collected at checkout via the Import One-Stop Shop (IOSS) system and remitted by our service provider. The customer will not face additional VAT charges upon delivery. However, the customer remains responsible for any customs duties, brokerage fees, or other import-related charges that may be assessed by customs authorities.

Payment Methods: We accept Credit Cards, Debit Cards, PayPal, Apple Pay, and Google Pay.

Order Process: To place an order, customers must add the item to their cart, view the cart, proceed to checkout, enter their shipping and billing details, select a payment method, and complete the payment.

Pre-Order and Back-Order Payments: All orders, including those containing pre-order or back-order items, are charged at the time of purchase. For details on pre-order and back-order terms, please refer to Section 17.

EU and UK Withdrawal Rights: If the customer is located in the European Union or United Kingdom, the customer has the right to withdraw from the purchase within 14 calendar days of receiving the goods, without providing any reason. To exercise this right, the customer must submit a withdrawal form at https://humansweatrecords.com/pages/EU-withdrawal-form. The customer is responsible for the cost of returning the goods, and goods must arrive within 30 calendar days of the withdrawal notice. For complete details, see the Return and Refund Policy.

Shipping and Delivery: We ship to select countries worldwide. For a current list of supported shipping destinations, the customer should check our shipping calculator at checkout or contact us at legal@humansweatrecords.com. Orders within the US are handled by USPS, UPS, and FedEx, as selected by the customer at checkout. Orders shipping internationally are fulfilled from our US warehouse, and delivery times may be longer than the estimates provided by carriers. Human Sweat Records ships from Texas state, USA. We aim to ship orders within 5-10 business days, regardless of the carrier or shipment preference. We offer the following shipping options: Media Mail for US customers and economy international shipping for customers outside the USA.

Automatic Shipping Insurance: Orders with a total value of $60 USD or more (including product cost and shipping) are automatically covered by full shipping insurance at no additional charge. This insurance covers the complete order value against damage, loss, mis-delivery, or theft during transit. For insured orders that experience these issues, customers must contact us at legal@humansweatrecords.com with their order number and evidence to file a claim. Orders under $60 are not insured - these carrier options are void of warranty, insurance, and guarantee, and we are unable to provide support or offer replacements in the event of damage or loss for uninsured orders.

Vinyl LP Shipping Specifications: All vinyl LP orders are shipped using professional mailers designed for optimal protection. Orders of up to two LPs (or one double LP) ship in a 15" x 12.75" x 0.8" wrap mailer with reinforced edges for additional protection. Orders of 3 or more vinyl records ship in a white tab box with front lock tabs for added security and protection. To minimize potential damages such as seam splits or jacket wear, some albums are shipped in their protective inner sleeve, separated from the jacket, while others may ship inside the jacket with protective plastic wrap. At this time, we cannot merge orders or provide partial shipping refunds. Customers are responsible for understanding these shipping conditions prior to purchase.

Customer Responsibility: Customers must provide accurate shipping information when placing an order. If an error is detected by our team, we will attempt to contact the customer. Otherwise, the order will be shipped as entered, and the customer will be responsible for any issues, with no refund available.

4. Return and Refund Policy

At this time, we might offer a return or refund (partial or full depending on the case) only if the item is delivered in a state where it does not operate as advertised. For vinyl records, this means poor or faulty audio quality caused by the item itself and not the player. Where a return/refund should be granted for such cases, video/audio proofs of the issue might be required. Additionally, pictures of any damage to the shipping packaging might be also requested. No-questions refunds are not possible at this time.

Some of our products are produced in very limited quantity so we, unfortunately, are unable to replace everything.

Pre-Orders and Back-Orders: Cancellations of pre-orders or back-orders are accepted within seven (7) days of placing the order, provided the items have not yet shipped. After this period, pre-orders follow the same return policy as regular items. Please refer to Section 17 for detailed pre-order terms.

5. Retention of Right to Change Offering

We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

6. Warranties and Responsibilities

We do not provide any warranties for our products or services.

7. Ownership of Intellectual Property, Copyrights, and Logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music, and all Intellectual Property Rights related thereto, are the exclusive property of Giovanni Rotondo and Human Sweat Records. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works thereof.

8. Right to Suspend or Cancel User Account

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if, in our sole determination, you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

9. Indemnification

You agree to indemnify and hold Giovanni Rotondo and Human Sweat Records harmless from any demands, loss, liability, claims, or expenses (including attorneys' fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Human Sweat Records or Giovanni Rotondo be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Human Sweat Records and Giovanni Rotondo assume no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorised access to or use of our secure servers and/or any and all personal information stored therein.

11. Right to Change and Modify Terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review this page periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service.

12. Promotional Communications and Marketing

You agree to receive from time to time promotional messages and materials from us, by mail, email, or any other contact form you may provide us with (including your phone number for calls or text messages).

If you don't want to receive promotional materials or notices via other channels, please notify us at any time. Users need to opt-in to receive regular newsletter emails and can opt-out from occasional services-related emails.

13. Preference of Law and Dispute Resolution

These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under, and enforced in all respects solely and exclusively in accordance with the internal substantive laws of England, United Kingdom, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by, a court of competent jurisdiction located in England, United Kingdom. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

14. Data Usage and Sharing

We may use third-party tracking technologies, such as advertising pixels, cookies, analytics tools, and session recording services for marketing and analytics purposes. This includes creating audiences with similar attributes for targeted advertising on external platforms. 15. Super Mega Club Membership Program

Overview: The Super Mega Club is a paid membership program operated through Patreon that provides members with exclusive benefits and early access to limited edition products from Human Sweat Records.

Eligibility and Enrollment: The Super Mega Club is open to anyone who subscribes through our Patreon page. By subscribing, you agree to Patreon's Terms of Service and this section of our Terms and Conditions. You must maintain an active paid subscription to receive member benefits.

Membership Benefits: Super Mega Club members receive the following benefits, which may be modified or expanded at Human Sweat Records' discretion:

• Early Access to Limited Editions: Priority access to purchase rare and limited vinyl variants before they are made available to the general public, subject to availability.
• Album Credits: Members who maintain active subscriptions at the time production assets are sent to pressing plants will be mentioned in the credits of new album releases. Album credits are permanent and cannot be removed once the album is manufactured.
• Discord Access: A special Discord role granting access to member-only channels, periodic hangouts, listening parties, and exclusive giveaways.
• Free Shipping: Members receive free shipping (up to $10 USD per order) on their orders for every 5 consecutive months of active membership. Free shipping credits are forfeited if membership is cancelled or lapses before reaching the 5-month threshold. Shipping costs exceeding $10 are the responsibility of the member.
• Additional Perks: Other benefits as announced from time to time, including early access to sales, exclusive merchandise, and member-only announcements.

Payment and Billing: Membership fees are processed through Patreon according to their billing terms. Human Sweat Records does not process or store your Patreon payment information. All billing disputes must be resolved through Patreon's support channels.

Membership Verification: To access benefits on our website or Discord, you may need to verify your Patreon membership status by linking your accounts or providing your Patreon email address. We receive limited data from Patreon solely to verify your active membership status.

Tenure-Based Benefits: Certain benefits, such as free shipping credits, are based on consecutive months of active membership. If you cancel and later rejoin, your tenure count resets to zero. We track membership tenure based on data provided by Patreon.

Benefit Limitations and Modifications:

• Limited edition item access is subject to availability and does not guarantee purchase rights.
• Album credit inclusion depends on membership status at specific production milestones and cannot be guaranteed for all releases.
• We reserve the right to modify, add, or remove benefits at any time with reasonable notice to members.
• Benefits are personal and non-transferable.

Cancellation and Refunds:

• You may cancel your Super Mega Club membership at any time through Patreon. Your benefits will remain active until the end of your current billing period.
• Membership fees are non-refundable except as required by law or Patreon's refund policy.
• Cancelling your membership will result in loss of Discord access, future album credits, and progress toward tenure-based benefits.
• Album credits already included in manufactured releases cannot be removed after cancellation.

Conduct and Termination: Human Sweat Records reserves the right to terminate membership access and benefits for members who violate these Terms, engage in abusive behavior, resell exclusive items for profit, or misuse member-only benefits. Termination for cause will not result in refunds.

No Purchase Guarantee: Super Mega Club membership provides early access opportunities but does not guarantee the ability to purchase any specific item. Limited edition items are subject to availability and may sell out even during member-only access periods.

16. The Vault - Limited Edition Collection

The Vault is an exclusive program for limited edition items offered by Human Sweat Records with specific eligibility requirements and restrictions.

Eligibility Criteria:

• The Vault is currently available exclusively to customers residing in the United States.
• To access The Vault, customers must:
  1. Have purchased an item from the current music collection, as determined in the requisites published on the vault releases page
  2. Be an active subscriber to our newsletter
  3. Meet any additional specific requirements that may be published with each Vault release

Item Availability:

• Items in The Vault are genuine limited edition products with extremely restricted quantities.
• The number of available items will be clearly specified for each Vault release.
• Once items are sold out, they will not be restocked or reproduced.

Access and Purchasing:

• Access to The Vault is not guaranteed and is subject to meeting the current eligibility criteria.
• Customers who meet the requirements will be notified of Vault opportunities through specified communication channels.
• Purchases from The Vault are final and subject to the standard return and refund policies outlined in Section 4 of these Terms and Conditions.

Modification of Access Criteria:

• Human Sweat Records reserves the right to modify Vault access criteria at any time.
• Current eligibility requirements will be clearly communicated at the time of each Vault release.

17. Pre-Order and Back-Order Terms

Pre-Order Definition: A pre-order is a purchase of a product that has been announced but is not yet available for immediate shipping. Pre-order items are clearly marked as "Pre-Order" on the product page with an estimated release date.

Back-Order Definition: A back-order refers to an item that is temporarily out of stock but will be available again in the future.

Payment Terms: All orders, including orders that include pre-order or back-order items, are charged at the time of purchase.

Manufacturing and Production Timeline: Some of our products are available for purchase before they are manufactured. Manufacturing completion dates may change without notice, and we do our best to share production timelines on our communication channels.

Product Appearance: Any mock-ups or images of pre-order items are for pre-visualization purposes only and are not guaranteed to represent the final product. While we strive for accuracy in representing our vinyl products, the manufacturing process for vinyl records can result in variations. The final product appearance, including vinyl color, packaging design, artwork placement, and any other visual elements, may differ from mock-ups to any degree. We reserve the right to make any adjustments to designs, colors, or specifications as needed during the production process without prior notice.

Colored Vinyl Variations: All colored vinyl records are handmade products, and significant color variations should be expected from copy to copy, even within the same pressing run. Product photos represent one example pressing and do not guarantee your copy will look identical. Color intensity, pattern distribution, swirl effects, and overall appearance can vary significantly. This is especially true for "random" or "recycled vinyl" variants, where each copy is unique and may look substantially different from product images. These variations are inherent to the vinyl manufacturing process and are not considered defects.

Cancellation Policy: Please contact us within seven (7) days of placing your order if you would like to cancel your pre-order / back-order. If your order is unshipped, we are able to cancel your order and offer a full refund.

Shipping: Once a pre-ordered or back-ordered item becomes available, it will be shipped according to our standard shipping procedures outlined in Section 3. Customers will receive a shipping confirmation email once their pre-order has been dispatched.

Combined Orders: If you place an order containing both in-stock items and pre-order/back-order items, the entire order will be held until all items are available, unless otherwise specified. If you wish to receive in-stock items earlier, please place separate orders.
